Terms of Service

Last updated 8 October 2026

These terms are an agreement between you and Eddie Nudel, an individual based in Israel who runs Orbigate ("we", "us"). They apply to the website orbigate.com, the Orbigate app and its emails (together, "the Service"). By creating an account or using the Service you agree to them. If you use the Service for a company, you confirm you may accept these terms for it, and "you" includes that company.

The short version. Orbigate helps you find and judge public tenders. The tender data comes from public sources we do not control, and the decision cards, translations and scores are written by AI. Both can be wrong or incomplete. Always check the official notice before you decide to bid, and never rely on Orbigate alone for a deadline, an eligibility rule or a legal question. The Service is a free beta, provided as it is.

1. The Service

Orbigate searches public procurement sources (such as the EU's Tenders Electronic Daily, national procurement portals and SAM.gov), shows matching notices, and offers AI-generated decision cards, translations, competition figures, lists of past winners, email drafts and alerts.

Orbigate is an independent service. It is not affiliated with, endorsed by or acting for the European Union, any government, any contracting authority or any procurement portal. It is not an official source of tender information.

2. Free beta

The Service is currently a free beta. Features, limits (such as the number of decision cards per day), sources and availability can change, and we may suspend or end the beta at any time. We will give at least 30 days' notice by email before we charge for anything, and paid plans will come with their own price and payment terms that you accept separately. Nothing changes into a paid plan without your agreement.

3. Your account

  • The Service is for business use by people aged 18 or over. It is not offered to consumers.
  • Give accurate sign-up details and keep them up to date.
  • Each account is for one person. Keep your password safe and do not share your account or access codes. Tell us at once if you think someone else has used your account.
  • You are responsible for what happens under your account.

4. Tender data

Notices, deadlines, values, documents, buyer details and award information come from third-party public sources. We collect, translate, classify and summarise them automatically. We do not check them and we do not guarantee that they are accurate, complete, current or still open, or that Orbigate finds every relevant tender. Sources can be late, change notices, go offline or block access, and our processing can introduce errors (for example in dates, time zones, currencies or translations).

The official notice and tender documents published by the contracting authority always prevail. You must check them, and any changes or clarifications to them, before you make any decision or submit anything.

Notice data is reused under its publishers' terms. Information from TED is © European Union and reused under Commission Decision 2011/833/EU. UK notices contain public sector information licensed under the Open Government Licence v3.0. Other national data is reused under the terms of each publisher, listed in the coverage section of our home page.

5. AI-generated content

Decision cards, fit and eligibility assessments, competition and "who wins" figures, translations, search suggestions and email drafts are produced automatically by an AI model from the notice data and the information you give us. They are estimates to help you decide where to look first. They can be wrong, incomplete or out of date, and they can state things confidently that are not true.

They are not legal, procurement, export-control, tax, financial or bid advice. You decide whether and how to bid, and you are responsible for that decision, for your bid and for meeting every rule and deadline in the tender. Get professional advice where it matters.

6. Acceptable use

You must not:

  • copy, scrape, download in bulk, resell, sublicense or redistribute the Service or its data, or use it to build a competing product;
  • use bots or automated access, except the calendar feed and emails we provide;
  • try to get around limits, access codes or security, probe or attack the Service, or reverse engineer it;
  • put classified information, export-controlled technical data, or other people's personal or confidential data into the Service (describe your company as you would in a public brochure);
  • use the Service for anything unlawful, including bid rigging, collusion, bribery, or contacting officials in breach of tender rules;
  • misrepresent who you are or that you are connected with Orbigate.

7. Export controls and sanctions

Many tenders on Orbigate concern defence, security or dual-use goods. You alone are responsible for complying with all export control, sanctions, anti-bribery and procurement laws that apply to you and to any bid you make. You confirm that you are not a sanctioned person or acting for one. We may refuse or end access where we believe providing it could break sanctions or export rules.

8. Your content

You keep all rights in the information you add (company profile, notes, search profiles and so on). You give us a limited right to store and process it, including through our service providers listed in the Privacy Policy, only to provide and improve the Service for you. You confirm you have the right to give it to us. If you send us feedback or ideas, we may use them freely.

9. Our rights

The Service, its software, design, texts, classifications and the Orbigate name belong to us. We give you a personal, non-transferable right to use the Service under these terms while your account is active. Notice data itself belongs to its publishers (see section 4).

10. Third-party services and links

The Service links to procurement portals and other websites, and uses third-party providers (for example Google and Microsoft sign-in). We are not responsible for their content, availability or terms.

11. No warranties

To the fullest extent the law allows, the Service and everything in it are provided "as is" and "as available", without any warranty, express or implied, including about accuracy, completeness, availability, fitness for a particular purpose, or that you will find, qualify for or win any tender. We do not guarantee that the Service or its emails will be uninterrupted, on time or free of errors.

12. Limitation of liability

To the fullest extent the law allows:

  • we are not liable for any indirect or consequential loss, or for loss of profit, revenue, contracts, tenders, bids, business opportunity, goodwill or data, including from a missed or wrong deadline, a missed tender, wrong tender data or wrong AI-generated content;
  • our total liability for all claims about the Service in any 12 months is limited to the greater of the amount you paid us in those 12 months and USD 100.

Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.

13. Indemnity

You will compensate us for claims, losses and reasonable costs (including legal fees) that arise from your breach of these terms, your misuse of the Service, your content, or your bids and dealings with contracting authorities, including any breach of export control or sanctions law.

14. Suspension and ending

You can stop using the Service and delete your account at any time in the app (Account › Delete my account). We may suspend or close your account if you break these terms, if we must for legal reasons, or if we end the beta or the Service; where reasonable we will tell you first. Sections 4, 5, 11, 12, 13, 15 and 16 continue after your account ends.

15. Changes to these terms

We may update these terms, for example when we add paid plans. If a change matters, we will tell you by email or in the app before it takes effect and ask you to accept it. If you do not accept, you can delete your account.

16. Law and disputes

These terms are governed by the laws of the State of Israel, without regard to its conflict of law rules. The competent courts in Tel Aviv-Jaffa, Israel, have exclusive jurisdiction over any dispute about them or the Service. Before going to court, please write to us so we can try to settle the matter informally within 30 days.

17. General

These terms and the Privacy Policy are the whole agreement between us about the Service. If a part of them cannot be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a company we set up to run Orbigate or to a buyer of the Service, and will tell you if we do. We are not responsible for delays or failures caused by events beyond our reasonable control. These terms are written in English, and the English version prevails over any translation. We send notices to the email on your account; you can reach us at eddie@orbigate.com.
